Over the weekend, the US Senate unanimously passed the Homebuyers Privacy Protection Act (H.R. 2808), a bipartisan bill aimed at protecting consumers from aggressive and unwanted mortgage solicitations. The legislation would amend the Fair Credit Reporting Act to prohibit the sale of mortgage applicant information—commonly known as “trigger leads”—to third-party lenders and marketers. These trigger leads often result in a flood of unsolicited calls and emails to consumers who are in the process of securing a mortgage, creating confusion and undermining the lending relationship established with their bank.
Under the new law, the sale of consumer information will be restricted to specific, limited situations where its use is transparent and accountable. The House passed the bill in June, and with Senate approval now secured, it heads to President Trump for his signature. The OBL has long advocated for reforms to the use of trigger leads and will continue to monitor the legislation as it heads to the White House for final approval.
